By accessing or using Exumpay's website, platform, or related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not access or use the Services.
These Terms form a legal agreement between you (the visitor, user, or client) and Exumpay, operated by EXUM Information Technology Consultants – FZCO (Licence No. 68944), DSO-IFZA, IFZA Properties, Dubai Silicon Oasis, Dubai, United Arab Emirates ("we", "our", or "us").
Exumpay provides software-as-a-service (SaaS) technology that enables businesses to offer branded payment gateway solutions. We are a software provider only — we do not handle, hold, or transfer funds. Our platform is PCI DSS compliant, providing a secure environment for the exchange of payment data between merchants and their chosen payment providers. Clients are solely responsible for ensuring their own regulatory compliance, licensing, and obligations under applicable laws.
You may use the Services only in accordance with these Terms and all applicable laws. You agree not to use the Services for unlawful, fraudulent, or abusive purposes, and to ensure that all integrations and merchant relationships comply with these Terms.
Certain Services require registration and an active account. You must provide accurate details when registering and maintain confidentiality of your credentials. You are responsible for all activity under your account.
Fees may be structured as subscription, licence, or transaction-based charges. All fees are non-refundable unless stated otherwise in writing. We may suspend or restrict access if payment is overdue. You are responsible for applicable taxes.
All intellectual property rights in the platform, software, and documentation remain the property of Exumpay. You are granted a limited, non-exclusive licence to use the platform and its white-label features for your business use. You may rebrand the platform but this does not grant ownership of underlying technology.
Exumpay maintains PCI DSS compliance and provides a secure environment for payment data processing. You are responsible for lawful handling of personal data. Exumpay takes reasonable measures to protect data but cannot guarantee absolute security.
You agree not to use Exumpay's Services for illegal transactions, high-risk sectors without authorisation, interference with system functionality, or uploading malicious code.
The Services are provided "as is" and "as available" without warranties of any kind. Exumpay disclaims all warranties including merchantability and fitness for purpose. We may suspend or modify the Services for maintenance or security reasons.
Exumpay shall not be liable for indirect, incidental, or consequential loss. Our total liability shall not exceed the total amount of fees paid by you in the 12 months preceding the event giving rise to the claim.
You agree to indemnify Exumpay from any claims, losses, or damages arising from your misuse of the Services, violation of law, or breach of these Terms.
We may suspend or terminate your access if you breach these Terms, fail to pay fees, or engage in harmful activity. Upon termination, your right to use the Services ceases immediately.
We may update these Terms at any time by posting an updated version on our website. Continued use constitutes acceptance of any changes.
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the Courts of Dubai.
If any provision is found invalid, the remainder shall remain in effect. These Terms constitute the entire agreement between you and Exumpay regarding the Services.
